Terms of Use

These terms cover ColorGull and every other app in the Gull Apps family, published by TomDApps LLC, a California limited liability company ("we", "us"). By downloading or using a Gull app you agree to them.
Apple's Licensed Application End User License Agreement also applies to every app bought through the App Store. Where these terms and Apple's standard agreement disagree, Apple's wins.
Your licence
We grant you a personal, non-transferable licence to use Gull apps on devices you own or control, in line with the App Store Terms of Service and Apple's family sharing rules.
You agree not to:
- Copy, redistribute or resell the apps
- Reverse engineer, decompile or disassemble them, except where law expressly permits it
- Remove or alter any copyright or ownership notices
- Use the artwork, music, recordings or the gull character outside the apps
Who these apps are for
Gull apps are made for young children and are meant to be used with a grown-up's knowledge. If you are under 18, an adult should agree to these terms on your behalf.
Settings meant for adults sit behind a parental gate. Please do not tell a child how to get past it.
What we own
The apps, this website, the gull character, the artwork, the songs and the recorded voice prompts belong to TomDApps LLC and are protected by copyright. The Gull Apps and ColorGull names and logos are our trade marks.
What you own
Anything you make with a Gull app stays yours. That includes voice prompts you record and pictures your child colors. These live on your device, we never receive them, and we claim no rights over them.
Purchases and refunds
Purchases go through the App Store, so Apple handles payment, receipts and refunds. We cannot issue a refund ourselves. To request one, use reportaproblem.apple.com.
Updates
We may release updates that add, change or remove features. We may also stop supporting an app or an older version of iOS. Where a change is significant, we will say so in the App Store release notes.
No warranty
Gull apps are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not promise the apps will be uninterrupted or error free. We have tested them carefully, but no software is perfect.
Educational content
Gull apps are toys that teach, not a curriculum, an assessment, or a substitute for teaching. They make no claim about a child's development, and nothing in them should be read as an evaluation of a child's ability.
Limitation of liability
To the fullest extent the law allows, TomDApps LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of a Gull app. Our total liability is limited to the amount you paid for the app.
Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
Apple's role
Apple is not a party to these terms and has no responsibility for the apps. Apple has no obligation to provide support. If an app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in California, unless the law where you live gives you the right to bring it somewhere else.
Changes
We may update these terms. The date at the top shows when they last changed. Continuing to use a Gull app after a change means you accept the new terms.
